Terms of service

The rules that apply when you create an account and use SiteNext.

1. About these terms

SiteNext is a construction site management service published by Sagar Luniya, Entrepreneur individuel (EI) (SIREN 844 903 443), 4 place de Bretagne, 35000 Rennes, France (“we”). These terms are the agreement between us and the company or professional that uses the service (“you”). By creating an account you accept them. If you create the account on behalf of a company, you confirm that you may commit it.

SiteNext is intended for professional use.

2. The service

SiteNext lets construction teams manage projects, schedules and tasks, site diaries, RFIs, attendance, team conversations, photos and reports. It is provided online, as a subscription.

The service is currently offered as an early-access beta. Features are added and improved continuously and some may change or be withdrawn. We tell you in advance when a change removes something you rely on.

3. Accounts

You give accurate information when you register and keep it up to date. Each person uses their own account; you keep your credentials confidential and are responsible for what is done with them. The admins of an organization decide who is invited to it, with which role, and on which projects.

4. Plans, trial and payment

The plans and their prices are those shown on the pricing page on the day you subscribe. The subscription is priced per admin; other team members do not count. Prices are in euros and exclude VAT.

  • A new organization gets a free trial of one month, with no payment method.
  • After the trial the subscription is billed in advance, monthly or yearly as you chose, through our payment provider Stripe.
  • You can cancel at any time from your billing settings. Unless stated otherwise, the subscription then stays active until the end of the period already paid for.
  • If a payment fails and is not settled after a reminder, we may suspend access until it is.

We may change our prices. A change never applies to a period you have already paid for, and we tell you before it applies to your next renewal.

5. Your data

Everything you and your team put into SiteNext — projects, diaries, photos, documents, messages, hours — remains yours. You give us only the right to host, process and display it in order to provide the service to you.

You are responsible for having the right to record that data, in particular the personal data of your employees and subcontractors: informing them, and using options such as position or photo at clock-in in line with the law that applies to you. We process this data on your behalf, as described in the privacy policy.

You can export your data with the reports and exports of the application. When your account is closed, your data is deleted after a reasonable period that lets you retrieve it, except what the law requires us to keep.

6. Acceptable use

You agree not to:

  • use the service for anything unlawful, or to store unlawful content;
  • try to access data that is not yours, or get around the security and the limits of the service;
  • disrupt the service or overload it with automated requests;
  • resell the service or copy it to build a competing one.

7. Features that rely on third parties

Some features rely on other providers — for example the transcription of voice notes and the scanning of a paper form into a template use an artificial intelligence service. Their results can contain errors and should be checked before you rely on them.

8. Availability and support

We work to keep SiteNext available and secure at all times, and back up its data. The service may nevertheless be interrupted for maintenance, an update or an incident. We do not commit to a guaranteed level of availability, unless a separate agreement says so. Support is provided by email at hello@sitenext.io and through the chat of the application.

9. Intellectual property

The software, the SiteNext name and logo, and the design of the service are ours. Your subscription gives you a personal, non-exclusive and non-transferable right to use the service for your business while the subscription lasts.

10. Liability

SiteNext is a tool: decisions about your sites, your teams and their safety remain yours. To the extent the law allows, our total liability for a given year is limited to the amounts you paid us for the service during the twelve months before the event, and we are not liable for indirect losses such as loss of profit or of business. Nothing in these terms limits a liability that the law does not allow to be limited.

11. Suspension and termination

You can stop using the service and close your account at any time. We may suspend or close an account that seriously or repeatedly breaches these terms, after asking you to remedy the breach when it can be remedied.

12. Changes to these terms

We may update these terms as the service evolves. The date at the top of the page shows the latest version, and we tell account holders by email before a significant change takes effect.

13. Governing law and disputes

These terms are governed by French law. If a dispute cannot be settled amicably, it is brought before the competent courts of Rennes, France.
